These Terms of Service ("Terms") govern your access to and use of the services provided by Zaman Labs LLC, operating as FirstCall ("FirstCall," "we," "us," or "our"). By using our website, booking a demo, or subscribing to our services, you agree to these Terms.
1. Service description
FirstCall provides an AI-powered front-office service for home-service contractors, including automated call answering, appointment booking, lead follow-up, review requests, and related communications. The specific features included depend on the plan you select.
2. User responsibilities
- Provide accurate business, contact, and configuration information.
- Comply with all applicable laws when using the service, including telemarketing and messaging laws.
- Maintain the security of your account credentials and integrations.
- Only use the service for lawful business purposes and not to send unsolicited or prohibited content.
3. Payment terms
Subscription fees are billed monthly in advance unless otherwise agreed in writing. Fees are non-refundable except where required by law. You may cancel at any time; cancellation takes effect at the end of your current billing period. Overdue accounts may be suspended.
4. SMS and messaging terms
By providing your phone number and opting in — for example, by submitting a demo request or checking an SMS-consent box — you agree to receive service-related and promotional text messages from FirstCall (Zaman Labs LLC). Message frequency varies. Message and data rates may apply. You can text STOP at any time to unsubscribe, or text HELPfor help. Consent to receive messages is not a condition of purchase.
When FirstCall sends messages on behalf of your business to your customers, you are responsible for ensuring you have obtained the necessary consent from those recipients and for complying with the TCPA, CAN-SPAM, and any applicable state and federal laws.
5. Limitation of liability
To the maximum extent permitted by law, FirstCall and Zaman Labs LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the service. Our total liability for any claim will not exceed the amount you paid us in the three months preceding the event giving rise to the claim.
6. Termination
We may suspend or terminate your access to the service if you materially breach these Terms or use the service in a way that creates legal or operational risk. You may terminate at any time by contacting us.
7. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email or through the service. Continued use of the service after the effective date constitutes acceptance of the updated Terms.
